ORS 205.232 states that a county clerk shall not accept a document for recording unless it meets the following requirements:

Oregon Domestic Partnership

 

 

On February 4, 2008 Multnomah County began registering domestic partnerships in accordance with the Oregon Family Fairness Act.  The law creates a domestic partnership system for same sex couples within the state of Oregon.

Multnomah County files domestic partnership registrations between 8:00 a.m. and 5:00 p.m. at its offices at 501 SE Hawthorne Blvd., Portland.  Telephone: (503)988-3034 (PRESS 2)

The Declaration of Domestic Partnership form must be notarized before it can be accepted.  The Oregon Secretary of State maintains a list of Notaries Public within the state and most banks and financial institutions employ notaries.

Effective January 1, 2010:

With the passage of House Bill 2839 during the 2009 legislative session, Oregon Registered Domestic Partners can document the legal name each will use after the Declaration of Oregon Registered Domestic Partnership form is filed.  The legal name to be taken after domestic partnership for Partner B is recorded on item 20 on the Declaration of Oregon Registered Domestic Partnership (form 45-6 (01/10)).  The law limits the options of the surname to:

  • retaining the surname prior to the partnership;
  • changing the surname to the other party's surname; or,
  • changing the surname to hyphenated combination of the partners A's and partner B's surnames, in either order.

The middle name may only be change if a new surname (last name) is selected.  In that situation, the middle name may only be changed to the person’s current surname (last name) at the time of partnership.

Recording Documents in Multnomah County

The Recorder's office is in the Multnomah Building at 501 SE Hawthorne Blvd in Room 158 on the first floor. Office hours and telephone hours are 8:00 a.m. to 5:00 p.m., Monday through Friday except legal holidays.

This office records:

  • Legal documents pertaining to real property or that may affect title to real property located within Multnomah County, Oregon.
  • Military Discharges (DD-214) Requests for certified copies of Military Discharges must be made in writing on the attached form and mailed or brought in person to the Recorder's Office.   

 


This office cannot:

  • Give legal advice
  • Provide blank instruments
  • Help fill out instruments
  • Suggest what type of instruments to use
  • Accept illegible, smeared instruments which may not provide a readable micrographic record
  • Record documents other than those specified by Oregon Statutes
  • Verify credit reports of any kind, although we can verify lien releases up through our index date.  For more specific update information, you may call (503) 988-3034 during our telephone business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday.

When a document is received in the Multnomah County Recorder's Office, it is reviewed for compliance with statutes controlling document types and content. If the document cannot be recorded, it is returned.  Once a document has been recorded, an alphabetical index is created and maintained by date and year.

A separate index is maintained by document number. All recorded documents are scanned to digital images and are available on microfilm in our Public Research Room.

Public Records Research in Multnomah County

The Recorder's Office maintains the public research room for certain Multnomah County, Oregon records. Among those records are Military Discharges (DD 214).  On June 24, 2009, a bill went into law, requiring non-disclosure of military records.  Because military records are co-mingled with all other records in public research, access to all records between the years 1964-2001 will be restricted until further notice.  The microfiche index and the internal, on-line index will still be available for research.  Our staff will be available to assist with review of or copies of specific documents.

When mailing a request for copies, please include the document number and the year of recording. If you are requesting a copy of a current deed and do not have the reference number, please submit the street address or tax account number, and the names of all interested parties. We do not accept telephone requests nor do we fax copies of documents.

  • Standard copies are $4.00 for the first page and $.25 for each additional page, within the same document.
  • Certified copies are $7.75 for the first page and $.25 for each additional page within the document. Most deeds are one page. Other documents, such as mortgages and trust deeds, may have several pages. If you are unsure, please contact us. We cannot process your request without the correct payment. There is no charge for certified copies of military discharges.

When you come to our office, the staff will assist you with your research by getting you started using the equipment and locating your record. The Public Research Room is located in the Multnomah Building, 501 SE Hawthorne Blvd in Suite 125 on the 1st floor. Record Types

Types of Records
  • Land records back to 1850.

    Because Oregon City was the territorial capitol of Oregon, land records prior to 1850 (indices and microfilm) for Multnomah County are in Clackamas County  . To research land records from 1850 forward, a legal description is necessary. (Old addresses may not work since many addresses and street names have changed.) Multnomah County has grantor-grantee indexes that are alphabetical and by year of recording.  Consolidated indexes are available from 1974 forward.


  • Property tax records, including characteristics for residential and some commercial structures, current and past tax rolls, sales, and owners indexes. 
  • Property Characteristic cards are available from 1994 to current.
  • Marriage record indexes between 1924 through 1980. Please call 503-988-3326 (Press 0) for marriage records.

To research marriage records, go to the License Counter in Suite 175 of the Multnomah Building.  Copies of Marriage Licenses are available for purchase at this counter.

Marriage Licenses
    

Obtaining a Marriage License in Multnomah County

General Information

Marriage Licenses are issued in the Customer Service Office, Suite 175, Multnomah Building,
501 SE Hawthorne Blvd, Portland, Oregon 97214-3577.

Hours are 8:00 a.m. to 5:00 p.m., Monday through Friday. Telephone: (503) 988-3034 (Press 2).

You do not have to be an Oregon resident to obtain a marriage license.

Oregon Law prohibits the issuance of a marriage license to anyone under 17 years of age.

Completing the Application:

DUE TO A SIGNFICANT CHANGE IN THE PROCESSING OF MARRIAGE LICENSES IN MULTNOMAH COUNTY, BOTH THE BRIDE AND GROOM MUST COME IN TO OUR OFFICE TO PURCHASE A MARRIAGE LICENSE.  IF CIRCUMSTANCES PREVENT BOTH PARTIES FROM APPEARING IN PERSON, CONTACT MUST BE MADE WITH A CUSTOMER SERVICE REPRESENTATIVE BY CALLING 503-988-3326 AND THEN PRESS 0.  THE FEE FOR AN OREGON MARRIAGE LICENSE IS $60.00 IN CASH OR CERTIFIED FUNDS ONLY.  THE LICENSE BECOMES EFFECTIVE THREE CALENDAR DAYS AFTER ISSUANCE AND PAYMENT.  THE LICENSE REMAINS IN EFFECT ANYWHERE IN OREGON FOR 60 DAYS.

NO MEDICAL EXAMS OR BLOOD TESTS ARE REQUIRED.  YOUR MARRIAGE CAN BE OFFICIATED BY A RELIGIOUS LEADER OR A JUDGE. A LIST OF JUDGES

THE MARRIAGE LICENSE APPLICATION REQUIRES BOTH THE BRIDE AND GROOM TO ESTABLISH THE LEGAL NAME EACH WILL TAKE AFTER THE MARRIAGE CEREMONY.  THIS INFORMATION IS CRITICAL AND MUST BE DETERMINED PRIOR TO THE COMPLETION OF YOUR APPLICATION.

Consent for Applicants 17 Years of Age:

Applicants who are 17 years old must obtain the written consent of their parent or guardian. If either applicant has no parent or guardian resident within the State of Oregon and has resided within Multnomah County for six months, an Affidavit stating these facts must be obtained from a third party. Obtain application from the Marriage License Section.

The Three-Day Waiting Period:

Oregon law requires a three day waiting period before a marriage can take place after a license has been issued. However, this waiting period may be waived by the Deputy County Clerk in Multnomah County. The waiver must be signed at time of application.

After the Marriage License is Issued:

REMEMBER, the license is not in effect until three days after it is issued. It remains valid for 60 days after the effective date.

The license can be used anywhere in the State of Oregon. Your marriage can be officiated by:

  • A religious leader who is authorized by a religious congregation/organization.
  • A County Clerk.
  • An Oregon judge. A list of Multnomah County judges is available from the Marriage License Unit.
  • An active Federal/Military judge. 

Two persons age 18 or older are required to witness the solemnization of the marriage.

Following the marriage ceremony, the completed License and Record of Marriage must be returned to the Multnomah County Marriage License Section within ten (10) days of your marriage. The officiating religious leader, judge, or County Clerk is responsible for returning the License and Record of Marriage. There will be no vital record until the completed License and Record of Marriage has been returned to the Marriage License Unit.

 

Multnomah County Domestic Partnership

Multnomah County Domestic Partnership Registration

General Information

County Domestic Partnerships are registered in the Customer Service Office, Suite 175, Multnomah Building, 501 SE Hawthorne Blvd, Portland, Oregon 97214-3577.

Registrants do not need to be residents of Multnomah County.

There is no waiting period.

Registration requires that both partners:

  • Must be present.
  • Reside together and are sharing the common necessities of life.
  • Are not married or registered as the domestic partner of another person in any jurisdiction.
  • Are at least 18 years of age.
  • Are not related by blood kinship closer than would bar marriage in the State of Oregon and are mentally competent to consent to contract.
  • Are each other's sole domestic partners and intend to remain so indefinitely and are responsible for each other's common welfare.
  • Agree to file a Statement of Termination of County Domestic Partnership Registration, if the partnership is terminated (except by death) or any of the facts set forth above change.
  • Understand that the registration of the Certificate of County Domestic Partnership is evidence of a domestic partnership of continuous duration.
  • Affirm that neither has filed a Statement of Termination of County Domestic Partnership Registration within the last six months.

A Certificate of County Domestic Partnership must be signed at the time of registration. The fee for registration is $60.00 in CASH or CERTIFIED FUNDS.  NO PERSONAL CHECKS. NO REFUNDS.


Termination Of County Domestic Partnership Registration Requires:

  • Statement of Termination of Domestic Partnership Registration to be filed.
  • Termination only requires one partner's signature - *NOTE.

A Statement of Termination of County Domestic Partnership fee is $25 CASH or CERTIFIED FUNDS.  NO PERSONAL CHECKS.  NO REFUNDS.

*NOTE: If only one partner is present to sign the Statement of Termination of County Domestic Partnership, that partner must certify that they have attempted to notify the other partner of the termination by mailing a notice of such intent, by certified mail return receipt requested, to the last known address of the other partner.

Frequently Asked Questions About Domestic Partnership

  1. Can a certificate be purchased but not registered?  No, registrants get a certificate when they register. That is the only way to get a certificate.
     
  2. Can a certificate be picked up and returned signed?   No. Both partners must sign the certificate in the presence of the clerk.

  3. Can a replacement certificate be purchased?  A new Certificate with the original document number followed by a "C" for copy can be purchased for $3.75. Both parties must be present to sign the replacement certificate.

  4. Can the termination papers be taken and then returned already signed?   NO.  The termination paper only requires one signature, so the form can be filled out by one partner who certifies that they attempted to notify the other partner of the termination.  The fee for filing a termination is $25, cash or certified funds.

  5. What are the requirements for witnesses on the certificate?  Witnesses are not required. The space is provided on the certificate for optional use by the registrants who may wish to have family, friends, or someone from their religious community sign.
