Since that date, Chapter 11.15 has undergone amendments, in which various sections and subsections have been added, repealed, modified or renumbered. Those amendments are annotated in the text of this 1995 edition on the following manner:

• Amendment of Entire District

  Annotations appear before the statement of purposes of the district at the same level in the outline as the section headings like so:

  11.15.2002 Purposes

  The purposes of the Exclusive Farm Use District are to preserve and maintain agricultural lands for farm use consistent with existing and future needs for agricultural products, forests and open spaces; to conserve and protect scenic resources, to maintain and improve the quality of the air, water and land resources of the County and to establish criteria and standards for farm uses and related and supportive uses which are deemed appropriate.

  11.15.2020 Lot Size for Conditional Uses

  1. The minimum lot size for a conditional use permitted pursuant to MCC .2012(A) and (B)(2) shall be based upon:

  1. The site size needs of the proposed use;
  2. The nature of the proposed use in relation to its impact on nearby properties; and
  3. Consideration of the purposes of this district.

  11.15.2008 Primary Uses

  1. Farm use, as defined in ORS 215.203(2)(a), except as provided in MCC .2012(B). [Amended 1990, Ord. 643 § 2]
  2. The propagation or harvesting of forest products.
  3. Thermal Energy Power Plants, when sited by the Energy Facility Siting Council as authorized under ORS 469.300 to 469.570, 469.590 to 469.621 and 469.930. [Amended 1990, Ord. 643 § 2]
  4. Climbing and passing lanes within the right of way existing as of July 1, 1987. [Added 1990, Ord. 643 § 2]

  11.15.2012 Conditional Uses

  1. The following uses may be permitted when approved by the Hearings Officer pursuant to the provisions of MCC .7005 to .7030:

  1. Public or private schools;
  2. Churches;
  3. Utility facilities necessary for public service, including transmission towers over 200 feet in height, except commercial facilities for the purpose of generating power for public use by sale; [Added 1990, Ord. 643 § 2]

  11.15.2008 Primary Uses

  1. Farm use, as defined in ORS 215.203(2)(a), except as provided in MCC .2012(B). [Amended 1990, Ord. 643 § 2]
  2. A single family dwelling on a Lot of Record used for farm use if the dwelling is:

  1. Located on the same Lot of Record as the dwelling of the farm operator; and
  2. Occupied by a relative, which means grandparent, grandchild, parent, child, brother or sister of the farm operator or the farm operator's spouse, whose assistance in the management of the farm is or will be required by the farm operator.

  1. The Board shall render a decision within 120 days from the time the application for that action is accepted as being complete, except when:

  1. A participant requests an extension before the conclusion of the initial evidentiary hearing, in which case the extension shall not be subject to the 120 day limitation, or
  2. Additional documents or evidence is provided in support of the application less than 20 days prior to or at the initial evidentiary hearing and a party requests a continuance of the hearing, in which case the continuance shall not be subject to the 120 day limitation.
